Terms of Service

1. Acceptance of Terms

By creating an account or using Whapture ("Service"), you agree to these Terms of Service. If you don't agree, don't use the service.

Whapture is operated by Dragon Advertising Ltd (Dragon Advertising EOOD), a company registered in Bulgaria (UIC/EIK 206419669, VAT BG206419669), with its registered office at zh.k. Hale, bl. 5, vh. I, ap. 173, 8600 Yambol, Bulgaria ("we", "us").

2. Description of Service

Whapture is a software-as-a-service tool that captures leads from WhatsApp, phone and form clicks on websites and sends conversion data back to advertising platforms such as Google Ads and Meta to improve campaign optimization.

3. Account and Registration

To use Whapture you must create an account using Google authentication. You're responsible for maintaining the security of your account and any activity that occurs under it.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Use the captured lead data for unsolicited marketing without proper consent
• Capture data from individuals in violation of applicable privacy laws (GDPR, CCPA, etc.)
• Reverse engineer, decompile, or attempt to extract the source code of the service
• Resell or sublicense the service without our written permission
• Use the service to harass, abuse, or harm others
• Interfere with or disrupt the service or servers

5. Subscription and Payment

The service may be offered with free, trial, or paid tiers. Paid plans renew automatically (monthly or yearly) until cancelled. You can cancel anytime; access continues through the end of the paid period. Prices exclude VAT and other taxes where applicable.

60-day money-back guarantee: if you request it by emailing support@whapture.app within 60 days of your first payment for a workspace, we refund that payment in full. Other refunds are at our discretion.

6. Data Ownership

You own the lead data captured through your workspace. We process this data only to provide the service. See our Privacy Policy for full details.

7. Service Availability

We aim for high availability but make no specific uptime guarantee in the free or beta tiers. Scheduled maintenance may temporarily interrupt service.

8. Termination

You may stop using the service and delete your workspace at any time. We may suspend or terminate your account if you violate these terms or for any other reason at our reasonable discretion, with notice when possible.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. We don't guarantee uptime, accuracy of conversion tracking, Google Ads import success, or any specific business outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the twelve months preceding the claim (or zero if you used a free tier). We are not liable for indirect, incidental, or consequential damages.

11. Third-Party Services

Whapture integrates with Google Ads, Meta, Google Tag Manager, Plato Medical, Supabase, Resend, Stripe, and Vercel. These services have their own terms and policies. We're not responsible for outages, changes, or pricing decisions on those platforms.

12. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your use of the service in violation of these terms or applicable law.

13. Changes to Terms

We may update these Terms occasionally. Continued use of the service after changes constitutes acceptance of the new terms. Material changes will be communicated by email.

14. Governing Law

These Terms are governed by the laws of the Republic of Bulgaria. Any disputes will be resolved by the competent courts of Bulgaria, without prejudice to any mandatory consumer protections in your country of residence.
